Enforcement Notice

An enforcement notice is a formal legal notice from the local planning authority requiring an owner or occupier to remedy a breach of planning control - typically by removing or reversing unauthorised development, or ceasing an unauthorised use. It specifies the alleged breach, the steps required, and the compliance period. The notice comes into effect 28 days after service; it can be appealed to the Planning Inspectorate within that 28-day window (which suspends the notice pending the appeal). Non-compliance after the compliance period is a criminal offence carrying an unlimited fine; the authority can also carry out the remediation itself and recover costs as a charge on the land. Time limits for enforcement: 4 years for operational development and change of use to a dwelling; 10 years for any other change of use.

Local planning authorities have discretion over whether to take enforcement action - they are not obliged to act on every reported breach. The authority must consider whether enforcement is expedient having regard to the provisions of the development plan and any other material considerations. Many minor breaches (small outbuildings slightly over the permitted development size limit, for example) are not pursued if the harm is limited. However, breaches in sensitive locations (conservation areas, listed building curtilages, green belt) are more likely to be enforced, and breaches that cause genuine amenity harm to neighbours will usually be pursued.

Receiving an enforcement notice is a serious legal situation requiring immediate professional advice. Options on receipt include: appealing the notice within 28 days (suspending it while the appeal is heard); submitting a retrospective planning application for the development (which also effectively pauses enforcement action while the application is determined); negotiating with the authority about the compliance period or steps required; or complying with the notice. Doing nothing is not a viable response.
