Certificate of Lawfulness

Also known as: Lawful Development Certificate, LDC, CLOPUD, CLEUD

A Certificate of Lawfulness (Lawful Development Certificate, LDC) is a formal legal declaration from the local planning authority confirming that a development or use is lawful. Two types: CLOPUD (proposed works - confirming they fall within permitted development and need no planning permission); CLEUD (existing works or use - confirming enforcement time limits have expired: 4 years for operational development, 10 years for change of use). Not the same as planning permission - it is a declaration of existing law, cannot be refused if the works genuinely comply, and cannot carry conditions. Runs with the land regardless of ownership. Strongly advisable before selling or mortgaging a property where works were carried out without formal permission.

Solicitors acting on property sales routinely raise enquiries about works carried out to a property - particularly extensions, loft conversions, and outbuildings built within the last 10-12 years. Where no planning permission was obtained (because the works were within permitted development), buyers' solicitors will often request a Certificate of Lawfulness or ask the seller to indemnify against enforcement action. A certificate is far preferable to an indemnity policy - the certificate is legally binding confirmation of lawfulness; an indemnity policy is insurance against the risk of enforcement, which implies there may be a risk to insure against.

Applying for a CLOPUD before carrying out permitted development works (rather than after) is good practice for any significant project. It provides certainty that the works are within permitted development before contractors are engaged, and produces a certificate that will be available when the property is eventually sold. The 8-week determination period means a CLOPUD should be applied for early in the project programme, in parallel with detailed design and Building Regulations work.
