Do Swimming Pools Need Planning Permission?
An outdoor in-ground or above-ground swimming pool in the rear garden of a house is usually Permitted Development in England. The pool itself is treated as an engineering operation in the garden and assessed under the same outbuilding rules - primarily the 50% curtilage coverage limit and the restriction on building forward of the principal elevation.
Key rule: the pool plus any associated pool house, plant room or other outbuildings must not cover more than 50% of the original curtilage of the house. The pool must not be in front of the principal elevation.
Permitted Development Conditions
- Pool is within the curtilage of a dwellinghouse (not a flat)
- Pool is not forward of the principal elevation
- Pool plus all other outbuildings do not exceed 50% of the original curtilage
- Any associated pool enclosure or pool house meets the outbuilding height limits
- No part of the pool is within 2m of any boundary if an associated pool house is also within 2m
When Full Planning Permission Is Required
- Pool is forward of the principal elevation
- Combined pool and outbuilding coverage exceeds 50% of the curtilage
- The pool enclosure structure exceeds the outbuilding height limits
- The property is listed
- The property is in a conservation area
- Article 4 Direction applies
Pool Houses and Enclosures
A pool house, changing room or plant room associated with the swimming pool is treated as an outbuilding and must meet all outbuilding PD conditions - including the height limits. A pool enclosure (a glazed or polycarbonate structure over the pool) is also assessed as an outbuilding.
If the pool enclosure is more than 2m from any boundary, it can be up to 4m high (dual-pitch roof) or 3m (other roof types). Within 2m of a boundary, the maximum height is 2.5m.
Building Regulations
The swimming pool excavation and shell construction itself does not require Building Regulations approval, but the following associated works do:
- Electrical installation - pumps, filtration, underwater lighting and any outbuilding electrical supply must comply with Part P. All work must be carried out or certified by a registered electrician.
- Pool house building - if over 30m², Building Regs approval is required for the building itself
- Gas heating - any gas heating appliance must comply with Part J and be installed by a Gas Safe registered engineer
Drainage and water: Consult your water authority if you plan to fill the pool from the mains supply. Large pools may require a water use licence. Pool backwash disposal must also comply with your water utility's requirements.
Conservation Areas and Listed Buildings
In a conservation area, swimming pools in the rear garden are generally still PD but you should confirm with your local authority. Listed buildings require Listed Building Consent for any ground works, even if planning permission is not needed.
